Waters of the US and the Clean Water Rule have been in the news for several years. President Trump has made numerous statements about the effect of the Clean Water Rule on the Nation’s economy and how he plans to change it.
There have been countless news stories about how the Waters of the US definition is confusing and needs to be changed.
So, what is this all about and how did we get here?
Waters of the US have been subject to Federal regulation since 1899. Over the years there have been many changes to what is considered jurisdictional and not. Today, we have a collection of laws, regulations, guidance and court rulings that determine if something is considered a Waters of the US.
While this may seem overwhelming, it really is not all that hard to understand. The Swamp School has been teaching classes on jurisdictional waterbodies and wetlands for over 10 years. Our instructors have over 30 years’ experience with this topic and we would like to help you.
The Swamp School has prepared a non-technical workshop that explains the current Waters of the US definition and brings together 118 years of US history with this topic. This workshop will cover the historic evolution of the Waters concept right up to today’s most recent interpretation, including Mr. Trump’s Scalia opinion.
